This presentation reviews many of the practical legal issues encountered in developing a Carbon Capture and Storage (CCS) project. The session will review legal issues at CO2 capture plants (such as contract, air permitting, intellectual property and tax incentives), CO2 Pipelines (such as DOT/PHMSA regulations and other state and federal requirements), and CO2 Storage Sites (such as injection well permitting and landowner consent), and provide an overview of the 45Q tax credit which is a primary incentive for CCS activity in the United States.

Keith Tracy is co-founder and Chief Commercial Officer of Elysian Carbon Management. Elysian is a carbon capture and storage project developer, owner, and operator that is developing carbon dioxide (CO2) capture, pipeline and storage projects throughout the United States.
Keith has been in the carbon capture business for 20 years. Keith previously worked for Chaparral Energy, where he directed all carbon capture project development, design, construction, and operations of CO2 capture plants and CO2 pipelines. Keith is also an attorney with private practice and in-house counsel experience.
Keith is a recognized 45Q expert who provided extensive input to the IRS 45Q regulations. He also helped start the Carbon Capture Coalition in 2011, which has been a primary proponent for federal carbon management policies.
