This presentation will review the holdings in Cimarex Energy Co. v. Anadarko Petro. Corp., Cromwell v. Onshore, and PBEX II, LLC v. Dorchester Minerals, L.P. We will discuss the current state of the law regarding Anadarko Washouts and the Adverse Possession of non-operated leases and interests. We will also discuss the actions currently pending before the Texas Supreme Court, the future of these types of claims, and how they can best be avoided by non-operators.
